The case should not have been accepted if the lady does not have constitutional rights. Lets see if they reject the case on this basis after listening to Tancredo.

If you were "scared to use the AC21", why not use it now, anyways ur ready to go back to India, what will u do with GC once u get it anyways?
Finally we have decided to go back to India for good. I filed my EB3 in May 2003. Its going to be another 4 years to get the green card. When I went to India for vacation last December, we liked it over there & the economy is booming. There are all sorts of discussion regarding the Economic Gap/Politics/Corruption/Cleanliness. But we like it over there. Finally I will have an option to do something interesting. In US I was very much dependent on my monthly pay check and afraid to take even the slightest risk. I am also scared to use the AC21(Hey, thats the way I am). I am working with the same company for last 10 years, kinda stagnant in the last 4 years. In India, there are lots of choices, either to work for a sw company or start some business on my own. I think I will take the business route.
May be I can go there, earn well, send my son to US for college, do green card through him & come retire in US!!!

I have observed in the past whenever an EB3 member brings a conversation of spillover to be used for older priority dates or for EB3 etc, the member has been marked with reds from EB2 members to express their dissatisfaction. Kondur, note that the infighting between EB3 and EB2 has been happening both ways for a very long time and USCIS has been successful in creating this divide.
Your thought process of change by lawmakers are noted. BTW the traction of EB2 members will always be lost every year around this time as EB2 candidates will end up bulletin watching till it affects that category.
This is a bitter truth we all have to swallow that between Jul - Sept every year there will be negligible EB2 members participating in IV's action items and on the other hand EB3 members feel that injustice has been dealt to them and end up feeling resigned.
At least this member sanhari is trying for something. If you all did not observe, he/she was voicing the same thoughts in the EB2-EB3 predictions thread, he was asked to not hijack that thread and was asked to create an own thread which was respectfully followed.
If we try to go offensive on members who are at least trying to do something than sitting idle, it is a shame. We need more EB2 members also who end up getting their green cards to comeback and support for this fight against EB3 members by contacting lawmakers to get some mass than talking about quarterly spillover etc. Because if the EB3 problems are addressed and we find a solution to resolve this backlog we never have to worry about spillovers or waitimes. But that rarely happens. Everybody wants a solution what works them or to be more precise, exactly till their priority date in their country and category.
I hope EB3 members start at least join this thread to show the support if not for this idea at least for future action items from IV Core. EB3 members have been passive whereas EB2 are active in predictions and bulletin watching. It really is disheartening looking at the participation or lack thereof in any EB3 threads. I hope we see some response at least...after which maybe IV Core can suggest how to proceed. When there is no participation, how much ever IV Core tries it is a difficult path. Note, IV Core is none other than members comprised with fellow candidates who are also stuck in this backlog.
Anyway sanhari, you are doing something better than doing nothing. So I commend you for that and I also appreciate how you respected fellow members sentiments in the EB2-EB3 predictions thread to create your own thread and not disturb their conversation. how to use the spillover is purely an USCIS decision. Only to use the spillover to avoid wastage is a law, which is already in place. Infact USCIS was not doing this top down approach on spill over few years ago, this is a new practice they are following since last Fiscal Year, so I strongly believe if Congressmen/women puts pressure/more request it can be changed to a fair application of visa spillover to benefit all that are in the queue for a long wait.

The only change for now is the delivery date - July 10th instead of 09th (FTD doesn't deliver on Mondays)
good some people are taking notice and doing it.. lets keep it rolling and hope atleast few more add on.. cmon guys its just 35$ after all these years and so much money spent what is 30+ bucks.. I promise I will contribute to IV also regularly... make the noise.. and make sure this thing is mentioned in the blogs too so if people miss it here they will read it there and respond...

My checks were cashed yesterday. My application reached NSC on July 14. My I-140 was also approved from NSC.
I got the receipt numbers from the back of the checks, however when I entered them on the USCIS website, it said that the numbers were invalid. Any idea if I need to wait another day or so before the system will accept them?

I know many cases like this, people approach these Bodyshoppers to get H1, or to convert H4 to H1..... many pay even H1 processing fees(which is illegal)..... just pray that after getting H1 they will get some project and the employer will pay....... they won't dare to ask employer.... becoz he can just revoke H1 and just be done with it...... many many cases....

Was your I-140 applied in Premium Processing?
Yes, it was PP, although it took a couple of months because they had to find the original labor cert from my first I140. The first one had a NOID because my attorney put the wrong name on the form....!

Hi,
I had started the thread a while back and I am glad to tell that I finally got my FP notice and completed the FP process.
I had opened a SR on Nov 5th after filing I-485 in July (receipt date Jul 23rd). I got a standard notice in Dec first week indicating that they shall schedule a FP notice when there is an opening available at ASC ( I guess a standard reply from what I have read in the posts). I then took an info pass on Dec 8th and it was also a seemingly non fruitful visit.
Finally on Jan 2nd I got a voice mail at work from attorney (dated Dec 26th) that my FP appt was on Dec 27th. I never got any notice to this effect till Jan 2nd in mail. Hence the attorney sent me his copy by FedEx and I drove the very next day (Jan 4th) to the ASC in Oakland, CA. I explained the situation and they were kind enough to schedule me the same day. The process was pretty straightforward, and was completed in about 10-15 minutes.
My spouse on the other hand did get her notice in mail and her FP appt is on Jan 11th.....
So am not sure what worked....the call to CS, taking an infopass, or just plan praying :)

As you have efiled your EAD the FP you have received might not necessarily mean the FP for 485, it could be just for EAD. Gurus any comment!!
Well in my opinion(although it doesn't count) an FP is an FP and it is for I-485 and EAD happens to use biometric information on the card.
I 'll try not to lose my sleep over it... chill!!!!!!!

Did you send out the latest letters...I am getting a positive feed back ..that approximately at least 500 letters have gone out..we started to make noise.. and we will see the results eventually...More action items will follow in comming weeks..Dont forget the high five though campaign though ;)
